Terms of Service

The terms governing your use of Brick AI's platform, website and related services, with the privacy policy covering how we handle data. Last updated: October 1, 2025.

01Acceptance of Terms

Brick AI Inc. (“Brick AI”, “we”, “us” or “our”) provides its platform, website and related services (the “Service”) subject to these Terms of Service (this “Agreement”). By accessing or using the Service you agree to be bound by this Agreement. If you do not agree, do not use the Service. If you are entering into this Agreement on behalf of a company or other legal entity, you represent that you have the authority to bind that entity.

02Changes to These Terms

We may change, modify, add or remove parts of this Agreement at any time. We will update the “last updated” date above when we do. Your continued use of the Service after changes are posted means you accept them. Where a separate written agreement governs your deployment, that agreement controls if it conflicts with this one.

03Accounts and Registration

Some features require an account. You agree to provide accurate, current and complete information and to keep it up to date. You are responsible for safeguarding your credentials and for all activity that occurs under your account. Notify us promptly at support@brick-data.com if you believe your account has been used without authorization.

04Privacy and Data

Your use of the Service is subject to our Privacy Policy below, which explains what we collect and how we use it. In summary: the Service is built around equipment, building and operational data, and we do not seek personal data beyond what is needed to provide and support the Service.

05Customer Data and Operational Control

You retain ownership of the operational data generated by your facilities and equipment. You grant Brick AI a limited licence to process that data to deliver, support, secure and improve the Service, and to produce reports and measurement for you. Where the Service issues control actions to your equipment, those actions operate within the setpoints, schedules and operating constraints you approve, and you remain responsible for the safe operation of your facilities and for your own control systems.

06Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law or regulation.
  • Transmit material that is abusive, harassing, defamatory, obscene or otherwise objectionable.
  • Send unsolicited or unauthorized advertising, promotional material, junk mail or spam.
  • Knowingly transmit adware, malware, spyware, viruses or any other code designed to interrupt, destroy or limit the functionality of software, hardware or telecommunications equipment.
  • Attempt to gain unauthorized access to the Service, other accounts, or any systems or networks connected to the Service.
  • Interfere with or disrupt the integrity or performance of the Service.

07Intellectual Property

The Service, and all software, firmware, models, content and materials provided through it, are the property of Brick AI or its licensors and are protected by intellectual property laws. Except as expressly permitted, you may not copy, reproduce, modify, rent, lease, loan, sell, distribute, mirror, frame, republish, download, transmit or create derivative works from them, in whole or in part. Feedback you choose to give us about the Service may be used without restriction or obligation to you.

08Third-Party Systems

The Service connects to equipment, control systems and third-party services that we do not own or operate. We are not responsible for the availability, accuracy or performance of those systems, and your agreements with those third parties remain your responsibility.

09Service Availability and Changes

We may modify, suspend or discontinue the Service or any part of it, temporarily or permanently, with or without notice. We aim to give reasonable advance notice of material changes affecting active deployments.

10Termination

We may suspend or terminate your access to the Service immediately, without prior notice or liability, if you breach this Agreement or where we reasonably believe suspension is necessary to protect the Service, our customers or your systems. Provisions that by their nature should survive termination, including intellectual property, disclaimers, limitation of liability and governing law, will survive.

11Disclaimers

Except as expressly stated in a separate written agreement, the Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. Energy, cost and performance figures presented through the Service or in our materials are estimates or measured results for a specific site and period; they are not a guarantee of future outcomes at any other site.

12Limitation of Liability

To the maximum extent permitted by law, Brick AI will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenues, data, use or goodwill, arising from or related to your access to, use of, or inability to use the Service, or the conduct or content of any third party in connection with the Service.

13Governing Law

This Agreement is governed by the laws of the State of Delaware, United States, without regard to its conflict of law principles.

14Privacy Policy: The Short Version

Brick AI is infrastructure software. The data that matters to us is operational: equipment performance, energy consumption, building and process conditions. We collect limited personal data, essentially business contact details and account information, and we do not build profiles of individuals or sell data to anyone.

15Information We Collect

Operational and equipment data. Meter readings, equipment status and performance, setpoints and schedules, sensor and control-system data, and related facility conditions, collected from systems you connect to the Service.

Account and contact data. Name, business email address, phone number, employer and role, provided when you register, request a demo or contact support.

Usage and device data. Log data, IP address, browser and device type, and pages visited, collected when you use our website or application.

16How We Use Information

We use the information we collect for the following purposes:

  • To provide, operate, secure and support the Service.
  • To build the operational models, optimization strategies and reporting the Service depends on.
  • To measure and verify energy, cost and demand outcomes against an agreed baseline.
  • To improve the platform, including model performance and integration coverage.
  • To respond to enquiries and provide customer support.
  • To meet legal, regulatory and contractual obligations.

17What We Do Not Do

We do not sell personal information. We do not use facility data to monitor or evaluate individual employees. We do not collect personal data beyond what is needed to deliver and support the Service, and where operational data can serve our purpose without personal identifiers, it does.

18Sharing

We share information with service providers who host, secure or support the platform under confidentiality obligations; with partners or installers directly involved in your deployment, where you have authorized it; with independent measurement and verification evaluators where a grant or utility program requires it and you have agreed; and where required by law or to protect the rights, safety and security of Brick AI, our customers or the public. In a merger, acquisition or sale of assets, information may transfer as part of that transaction.

19Security

We use an enterprise-minded architecture: controlled connectivity, access management, least-privilege permissions, logging and secure update practices. Specific controls are confirmed with your security team during review. No system is perfectly secure, but security is a design requirement of the platform rather than an afterthought.

20Data Retention

We keep operational data for as long as needed to provide the Service, produce measurement and reporting, and meet contractual and legal obligations. Account and contact data is kept while your relationship with Brick AI is active and for a reasonable period afterwards.

21Your Choices

You can request access to, correction of, or deletion of personal information we hold about you, and you can unsubscribe from marketing email at any time using the link in the message. Contact support@brick-data.com to make a request. Deletion of operational data tied to an active deployment is governed by your service agreement.

22Cookies

Our website uses cookies and similar technologies to operate the site, remember preferences and understand usage. You can control cookies through your browser settings; blocking some may affect how parts of the site work.

23Children

The Service is a business product and is not directed to children. We do not knowingly collect personal information from anyone under 16.
